The Jewish community is outraged after a California district attorney's office signaled that a community college professor could escape a lengthy prison sentence after he struck an elderly pro-Israel protester with a megaphone, which led to him falling backwards onto the ground and later dying at the hospital from blunt force trauma, according to the medical examiner.

Alnaji was initially facing up to four years in prison for the matter as he fought the charges against him, but on Tuesday he reversed course and the court "indicated that it is likely to place Alnaji on formal probation with up to 365 days in jail," according to the Ventura County District Attorney's Office, which said it was displeased with the move.

Paul Kessler, 69, was "an ardent Democrat" with "a sharp wit" who "loved a good takedown," said Kyle Jorrey, a former editor at the Thousand Oaks Acorn. He was also one of the newspaper’s "longest active letter writers." Kessler, 69, was involved in an altercation during the simultaneous protests Sunday, Ventura County Sheriff James Fryhoff said. He died a day later from injuries he sustained after he fell backward and hit his head on the ground during a confrontation between the two factions. Kessler, who was Jewish, was part of the pro-Israel group. 

"My husband left the house with an Israeli flag and he never came home," his wife, Cheryl, told Moshe Bryski, a rabbi from Chabad of Agoura Hills.

Bryski said he reached out to Kessler's wife after he found out the couple had attended services at his synagogue. The family has asked for privacy and plans to hold a private funeral after realizing thousands would want to attend, Bryski told NBC News on Tuesday. Hundreds of people have offered to help the family cover funeral costs, he said.

Like other incidents that have erupted across the country since the start of the war, Bryski — who just returned from Israel visiting with families of hostages held by Hamas — said Kessler’s death has brought the overseas conflict home.

"When you see a picture of a 69-year-old man holding an Israeli flag on the street corner," he said, "and to find out that two minutes after that picture was taken, he's shoved to the ground, he hits his head, and he’s no longer alive, it makes us wake up to realize that there are consequences, that there’s real hate there on the streets."

Still, Bryski said, Jewish people should not hide their identities.

Fryhoff said at a news conference Tuesday that there have been conflicting accounts from witnesses from both sides of the demonstrations about what led to Kessler’s fall. He urged anyone with information or footage of the protests to come forward and implored people not to spread false information.

Investigators have identified a suspect, who has only been described by authorities as a 50-year-old man, but no arrests have been made, according to Fryhoff. The suspect stayed at the scene and was one of multiple 911 callers who requested medical assistance for Kessler, the sheriff told reporters.

Detectives obtained a search warrant for the suspect and his Moorpark residence on Monday, according to the sheriff, who did not specify what investigators were looking for during the search. He was detained and released more than an hour after a traffic stop in Simi Valley.

Kessler’s death is being investigated as a homicide, Fryhoff said.

Kyle Jorrey, a former editor at the Thousand Oaks Acorn, remembered Kessler on X as "an ardent Democrat" with "a sharp wit" who "loved a good takedown."

He was also one of the newspaper’s "longest active letter writers," Jorrey said in an interview Tuesday. Kessler wrote editors consistently for more than 20 years on topics ranging from climate change to the Covid vaccine. His last contribution was in September.

“Doesn’t surprise me at all that he was out there as a counterprotester even at his age,” Jorrey said. “He was passionate about political issues (liberal causes) and wasn’t afraid to let people know how he felt.”

A Southern California college professor will stand trial for the involuntary manslaughter and battery of a Jewish counter-protestor after he was struck with a megaphone before falling and dying during a demonstration last year.t

Loay Abdelfattah Alnaji, 51, will be tried after Superior Court Judge Ryan Wright deemed there was enough evidence to proceed, several months on from the incident, according to the Ventura County District Attorney's Office.

Alnaji, 51, is accused of striking Paul Kessler with a megaphone in November during a confrontation at an event that started as a pro-Palestinian demonstration in Thousand Oaks, a suburb northwest of Kessler, 69, fell backward and struck his head on the pavement. He died the next day at a hospital.

Alnaji was charged with involuntary manslaughter and battery causing serious bodily injury, with special allegations of personally inflicting great bodily harm injury on each count, the DA's office said. 

If found guilty of all charges, he could be sentenced to more than four years in prison.

A Palestinian supporter appears to help Kessler after he clashed with other protestors 

Alnaji, a professor of computer science at Moorpark College, had espoused pro-Palestinian views on his Facebook page and other social media accounts, many of which were taken down in the days after Kessler's death, according to the Los Angeles Times. 

Witnesses told ABC Los Angeles at the time of the attack, on November 5, that both sides had been antagonizing each other when it turned physical.

'They were both on an even ground, and they were yelling at each other, and then the man brought his megaphone up and hit Paul, and Paul went down,' one unnamed witness said. 

Kessler was initially reported to have been involved in a tussle with another person where he fell backward and hit his head on the ground.

The Jewish Federation of Greater Los Angeles claimed Kessler was 'struck in the head by a megaphone wielded by a pro-Palestinian protestor'. 

Harrowing social media footage showed him lying on the ground with a pool of blood under him as medics rushed to help him. 

One of the organizers of the Pro-Palestine side of the protest, the Conejo Valley Antifascists, said in a message on X at the time: 'We have some news to share tomorrow about the tragic loss of life over the weekend. 

There are irresponsible assumptions and accusations flying around.

We have facts not yet reported that may surprise some in our community. 

We are heartbroken and will have more to share soon,' the group said.

Sheriff's deputies arrived and found Kessler with a head injury. He was taken the hospital, where he died the following day. 

Cops then launched an investigation as his autopsy ruled his death a homicide.

At an arraignment in November, Alnaji pleaded not guilty to one felony count of manslaughter and one felony count of battery causing serious bodily injury.

He also denied special allegations that he personally inflicted great bodily injury.

Protests continue to escalate between pro-Israeli and pro-Palestinian factions as the war in Gaza rages on with no end in sight.

Anger was felt at George Washington University last week when pro-Palestinian demonstrators were seen in shocking footage holding a mock trial calling for the beheadings of school administrators.
